Decision Summary: On 28 June 2013 the Office of the Migration Agents Registration Authority (“the Authority”) made a decision to cancel the Agent’s registration as a migration agent.

Following the Authority’s investigation of four complaints, the Authority was satisfied that the Agent had breached the following clauses of the Code of Conduct for registered migration agents: 2.1, 2.3, 2.3A, 2.4, 2.6, 2.8, 2.10, 2.23, 5.2, 5.5, 6.1, 6.2, 6.3, 7.2, 8.1, 8.2, 8.3 and 9.3.

In summary, the Authority was satisfied that the Agent:

– failed have due regard to his clients’ dependence on his knowledge and experience;
– engaged in misleading and deceptive advertising to exploit a particularly vulnerable client group;
– did not act in the best interests of his clients, or act in accordance with his clients’ instructions; and
– engaged in conduct which damaged the reputation and integrity of the migration advice profession.

The Authority was also satisfied that the Agent is not a person of integrity, or otherwise not a fit and proper person to give immigration assistance.

The Authority considers the Agent’s conduct to raise legitimate and justifiable concerns that the Agent poses a serious risk to consumers should he be allowed to continue to practice as a registered migration agent.

In accordance with section 292 of the Migration Act 1958 (Cth), a registered migration agent who has had their registration cancelled must not be registered within 5 years of the cancellation.
